Faculty Dismissal Policy

The Faculty Dismissal Policy provides for dismissal of a faculty member whose employment is otherwise secured, either through tenure or through other contractual obligations pertaining to her or his faculty rank. This policy has been in place for many years, but revision is necessary because it does not currently account for situations and procedures related to new Title IX regulations. This revision has been approved by the Faculty Senate.

Overview of Revisions (most related to Title IX; a few unrelated refinements that arose during this review):

Add exclusion in the case that we are required by law to dismiss someone (e.g., for failing to report violations of Title IX)

Add changes to notifications necessary in Title IX cases and other rights of the complainant to attend, provide evidence, etc.

Add changes to fact-finding in Title IX cases (delegating some of that to Title IX office)

Clarify faculty rights to appeal within Title IX process

Address conflicts between employment contract and dismissal policy

Address inability to appear on the part of the accused

Specify training for members of the Dismissal Committee

Clarify notice and response

Change process for suspension pending hearing

Remove Board of Regents from appeal process
